  • Can you gave them Marriage Certificate for K1 interview ?

    Hi,
My fiancee got the package that has all the document she has to have :

. Birth Certificate and English translation
    · Police Certificate and English translation
    · Court Record and English translation
    · Singlehood Certificate and English translation
    · Original Marriage Certificate plus a copy and English translation if applicable
    · Original Divorce Certificate plus a copy and English translation if applicable
    · Death Certificate of previous(s) spouse and English translation if applicable
    · Medical Record from one of our panel physicians, see attached list
    · 2 Photos (5cmx5cm) white background
    · $350 or the equivalent in Moroccan Dirham, paid in cash at the consulate.
    · Form DS-230
    · Form DS-156 x 2
    · Form DS-156K
    · DS-157
    · Affidavit of Support Form I-134 + Most recent year tax returns.

    My questions :
    1) what Original Marriage Certificate is ?

    2) If you just married one month before the approval of K1 visa, should the fiancee prepares :

    Marriage Certificate

    instead Singlehood Certificate

    ?

    thanks

If you just got married to your fiance, then you no longer have a fiance. He/she is your spouse.
You are then no longer eligible for a K1 fiance visa. You would have to start over with a spouse CR1 visa.

Your question--Can you gave them Marriage Certificate for K1 interview ?
If you do, then you will be denied a fiance visa at the interview because you are married. If you don't tell them you got married and get a fiance visa anyway, then when you try to get a greencard or later citizenship they will need the marriage certificate. If the date is before your visa, then you entererd the US with the wrong visa. Fraud. Misrepresentation. Trouble in your future in the US.

Have you married your fiance yet? If you have not, then you do not need to submit the marriage certificate. If you have, he will likely be denied the visa. You may try to amend it, but there is very little time left.
