Applied for K1 - can Fiance visit on an ESTA?

Just applied for a K1 Visa for my fiance who lives in the UK.

Can he visit with the Visa Wavier / ESTA with proof that he has a return flight back to the UK within 90 days?

There is no law against it and the airport guys do not know any visa/petition has been filed. They suggest bringing proof of ties to the UK like letter from employer, a lease, utility bills...things that indicate he has a life and reason to go back to the UK. The longer he says and the more often he visits, the more likely he might get further questioning, ie stays 89 days, goes home 4 weeks, returns for another 90 day stay. Eventually they may say enough and refuse entry. It's up to the officer and how he perceives your fiance as a risk of not leaving the country when he says he is.
