Hello All!
i need to know what i need to do to bring my fiance in the country. I live in the US and i'm a us citizen. I have been separated from my husband since february of 2011 and just filled a divorce using a lawyer in 04/2012- i was told that the process will take 6 weeks. but while separated from my ex husband i dated a guy in spain and we met march 2012 in Paris. we would like to get married ASAP. i UNDERSTAND THAT I HAVE TO FIRST FINALIZE THE DIVORCE AND APPLY FOR k1. bUT CAN I BE REJECTED BECAUSE OF THE LENGHT OF TIME I WAS DIVORCE . PLEASE ADVISED
ALSO WHAT ARE MY CHANCES OF OBTAINING A K1 FOR MY FIANCE , HE IS NOT WORKING AT THIS TIME -- HE WAS LAID OFF FROM HIS JOB. hOWEVER I DO HAVE A JOB AND I'M CURRENTLY MAKING $34000

Hi,

Yes, you must be divorced before you can apply for K1 visa. Since it will be right after your divorce that you will be applying for the K1 visa, I would make sure to include a "convincing" letter along with your other documents that states you are absolutely done with your last marriage and that you are in love with your new fiancé. So, if you provide the INS with all the proper documents and supporting evidence you should get the K1 visa. And it won't make a difference if he has a job or not. You will be the person who needs to have an income. I believe it's around $19,000 per year for two people. Well, I hope this helped.

No, when you met him does not matter-as long as it had happened within 2 years of petition filing date. However, you must supply a final divorce decree with your K1 application...So, do not file until that is done...It takes anywhere from 6-8 months for him to come to the US...

You do need to make sure u have plenty of evidence of ur relationship. lots pf pics with u and him and his family and conversations between the 2 of u from skype fb or texts and anything showing u were there to see him. im in the process of the fiance visa myself and i have an atorney doing it to make sure everything is done right and this is everything she told me i needed but u do need ur divorce decree for sure i had to provide mine even though i have been divorced for 11 years... hope this helps and good luck
