  • Fiance or Spouse Visa?

    I'm getting married to a U.S. Citizen in Aug 2012. Wedding is planned to be in India.
    Our plan is to fly back together to USA post marriage in August.

    Please suggest if I would need to apply for a fiance visa or a spouse visa to make this happen?
    Our Case:

    I - Husband - Naturalized US Citizen based in East Coast.
    Her - Wife - H1 - Working for an Indian MNC for a USA client based in West Coast.

    Married recently in India according to Hindu traditions.

    Current Status - Preparing I 130 - I 485 - I 765 and other docs package for AOS for wife.

    I am currently outside USA holding a H1 visa valid till July 2013.I am getting married to a U.S. citizen in Aug 2012.

    In case, I apply for a fiance or any other dependent visa to fly along with my husband after marriage, would my H1 still be active ?

      How about filing a fiance visa now ? What is the typical turnaround time for attaining it ?

        You can apply for a Fiance Visa which is processed within 6-9 months. You can also opt to apply for spouse visa but only after your marriage. From the time you get married, you can file a spouse visa, the processing lasts for 9-12 months.
        Either way, you need to wait a while before you can join your fiance in US.
