  • H1-b route or change of status and green card route? Any advice greatly appreciated

    Hi everyone!

I will try to keep this short and sweet.

My fiance and I have been dating for two years. He is currently in the USA on a j-1 18 month trainee visa that expires next year. I am an American citizen. My fiance's visa has offered to sponsor him on the h1-b visa. My fiance and I aren't sure if we should go the h1-b visa route and still get married next year or get married, apply for the change of status, and get his green card before his j-1 visa expires. There are pros and cons to both situations.

I believe if we go the h1-b visa route, my finance won't have to pay for social security and other taxes. Some pros for going the change of status and green card route through marriage are my finance could work for a different company if he wanted to and would be on the path for becoming a naturalized citizen.

My fiance is from another English speaking country. Our plan is to live in the USA for the next 3 years (at least) so I can finish up university. We definitely want to get married next year. After I finish university, I think we are moving back to his country for 5-10 years then coming back to the USA for good.

I personally would prefer for my fiance to go through the naturlization process now because it would put my mind at ease. We would never have to worry about US immigration again unless we had children in a foreign country etc. Plus after he were to become naturlized, we would move to his country for 5-10 years, then move back to the USA with no problems. Now we have the money, I just wouldn't want anything in the way of us moving back to the USA after living in his country for 5-10 years. Any thoughts?

From how I understand it, he can start the naturlization process when he has held his green card for 2 years and 9 months. If you apply for naturlization at 2 years and 9 months from receiving your green card, how long does the whole naturlization process take if everything on your application is correct?

    Thank you
