I have a approved H1 petition with just my name included, I went alone for the Visa Interview in Hyderabad on Oct 19th and my Visa is approved. Awaiting the passport with the stamping.
My question is can I now apply for a H4 for my wife and daughter using my I 797 / I 129 & LCA and approved H1-B? My concern is since my petition doesnt have their names, are they eligible or not. If they are not eligible to apply, can you let me know what needs to be done in this case? We want to travel together to avoid the hardships of travelling alone with a 3 year old.
