My wife got her H1B. She was on H4 till 1st October. What is the leagal status of my wife. Is she on H1 or H4. Her job has not started and she has no paystubs as of now.

If she received her H1B 797 along with an new I-94 then she is supposed to be workign and getting paid on H1 and if she is not working and doesn't have a job then she is already Out of Status.
