====H1B transfer case Query by dawnfood======

HI

I am currently in California via Indian companyA.And my current h1B is valid till Oct2013.The I94 is also valid till Oct2013

I have filed for H1 transfer through Comp.B (2 days back) Appreciate if you can help on below queries:

1. If the H1 transfer is approved, will I get the new I797 for 3 years (assuming that uscis aprroves it for 3 yrs) ??

OR

2. Will the Comp.B I797 valid till Oct2013 only (to match the earlier petition end date of comp.A)??

A. If case 1 is true, will the I94 also valid till 3 years to match new I797 end date?

OR

B.will it be till Oct2013 I94? If this true, do i have to go back to India forcibly to get a new I94?

I am sure there will be similar question asked earlier, but I could not find after looking a few pages of the forum.

You will get it up to the validity dates of your new LCA, maximum 3 years.

Has nothing to do with the H1 duration of your previous employer.
