  • Can I renew/reuse the expired H1-B, but been there in us only for 3 months on that

    Hi,

I have few questions on the H1-B Transfer/Renewal with the expired H1-B. Here is the summary.

    - Applied for H1-B through my second last employer on Apr 2009 and got the petition approved and got H1-B with 2 years validity (Aug 2009 - Jul 2011)
    - Worked in US from Dec 2009 - Mar 2010. Stayed in US for about 3 months with the H1-B that I had
    - H1-B got expired in Jun 2011
    - Worked in India/Canada until now.

I wanted to know the following things

    (1) I know, I can stay in US up to maximum of 6 years with the same petition/I-797B. So, is there any way I can renew/transfer my expired visa.
    (2) If yes, what will be the validity of the new one?
    (3) Do I need to go through the CAP process (I mean, lottery & maximum 65K visa per year)
    (4) What is the process involved if I can renew it somehow? Can I use the same I-797B?
    (5) Will the processing be faster?
    (6) I got the visa from a Service Based organization. Now, I am working for a Product Based organization based out of US. Will that help/create any issues in anyway?
    (7) If I can transfer/renew, how long I can stay in US to the max? 6 years - 3 months = 5 Years 9 months?

Any help in this regard would be appreciated. Thanks in advance

    Br,
    Praveen
