  • H1B Tranfer Question.

    Hi all,

    I am in my 7th year of H1B and am currently working for company A. I have an approved I-140 filed by company A. Last Month, I got a job offer with company B. My H1 was transfered to B and got extended until Oct-2015. I am planning to start working for B in 12-3-2012.

    Now I have got a much better offer from company C who is ready to do H1 transfer on premium processing.

    I like to join Company C. Can someone please help me with the options that I currently have?

    Can company C transfer H1 using the approval notice (I797) filed by company A as I am still working for Company A?

    Or Should the company C use the approval notice (I797) of company B for H1B transfer? If this is the case, how do I deal with the pay slip requirements? I do not have any pay slips with B. My start date with company B is 12/3/12. Company C plans to file for H1 transfer before 12/3/12. Can Company C file for H1 transfer using I797 of Company B and using the pay slips of Company A?


    Please help me! It may sound unethical, but people in H1B do not have cushion to pick and choose what they want. Company C offer is very attractive and I can't resist myself from exploring all possible legal options.

    H1B Visa transfer on L1B

    I am on L1B visa with employer ‘A’ and my H1B is approved with COS but not yet activated with employer B.

    My H1 COS will start from 29th Nov with employer ‘B’

    Now I have offer from C employer, Can Employer C file H1 transfer before 29th Nov?

    Or

    Can ‘C’ employer file new H1 without cap restriction?


    Or

    Is there any legal way to join employer C in near future?
