  • any rule that an emp has to b employed 4 min 1 yr, for initiating H1B visa process

    Hi All,

Is there a rule that we need to employed for atleast one year with current employer for initiating H1B visa process?

ex: i recently joined a company, and i m looking for a H1B visa. since this year quota is already filled. Company can initiate only after April 2013. but since i joined the company in November, 2012. I wont be completing 1 year by April, 2013. Is this fine? Can my company initiate a H1B visa process in April, 2013? Is there no limit/restriction/rule on the amount of time spent in the company?

Any information would be of great help.

    Thanks In Advance.

    Regards,

    Srinivas

    Yes, it seems so.
This is my opinion. Not a legal advice

There is no such law. But, it may be your employer's policy.
