  • 221g for H4 at Hyd consulate

    Hi All

My wife went for H4 stamping on Oct 29th at the Hyderabad consulate. My H1 is approved 2 weeks backs and still in India. There is only one question that the VO asked, do you have the pay slips of the principal applicant, she said no becuase he still has not travelled to the US. She got a 221(g) white slip, stating

"PETITIONER HAS A HISTORY OF WAGE VIOLATIONS, NEED TO SEE EVIDENCE OF INCOME/SUPPORT BEFORE I CAN ISSUE"

One day later, my wife got an email asking to submit Principle Applicant's evidence of Income docs at OFC or VFS office for further processing of your case.

These two are conflicting reasons the reason on the 221 form indicates something with the employer, in the email, it seems that they are looking for my income docs. I am confused as to what do I need to submit as an evidence of income docs when I am still yet to go to the US. My wife has carried the original offer letter for the interview, would it help if I submit the Offer letter and employment letter to the VFS?

    Thanks in Advance

    It is not conflicting.

They want to know that if your employer does not pay you salary, how will you support your wife when both of you are in the U.S.

Thanks for the response, but it is leading to another question. Should I be submitting any property documents and my bank balances in India to prove that I have enough funds to support for a short term? The same question can arise out of all the H4's, it would be really helpful, if I know what is the best way I can satisfy the visa office about this.

Typically they need to see the latest two pay-stubs. Send them two of the latest pay-stubs from your current employer in India. Also send the offer letter which shows your salary in the US and yes send other related financial documents preferably your bank accounts details/retirement fund etc.
