I am currently working for Company 'A' which is sold to company 'B'
I have completed my 6-year H1 from company 'A' in Sep 2012 and have PERM in progress applied last year June 2011 and as it is more than 365 days, I have got 1 year H1 extension which is valid till Sep 2013.
I have the following questions::
1. For instance if I get my H1 transfer approved from company B and company B applies for fresh PERM petition some time in Jan / Feb 2013, If my old PERM(company A applied back in June 2011) or the new PERM(that will be applied in Jan / Feb 2013) does not get approved by Sep 2013, can company B extend my H1B for one more year after Sep 2013 based on my old PENDING PERM from company A applied back in June 2011.
2. What happens if my PERM from company 'A' gets approved and the new PERM from company 'B' still in progress during Sep 2013. I remember there is a period of 180 days after the PERM gets approved when it gets inactivated in case of the I-140 not being applied.
My concern is will my stay in US gets effected beyond Sep 2013 in case of the company B's PERM not getting approved by Sep 2013. I am not concerned about losing my Priority date.
Please help me here as I am really worried about this and if I need to act fast now on anything else, please let me know your suggestions.
