Hi,
My H-1B is expiring in April 2006 after 6 consecutive years being an H-1B holder.
My employer has never filed a labor certification or an I-140 on my behalf.
As my visa expires in less than 9 months and no labor certification is pending, I am not eligible to apply for a 7th year extension according to everything I am reading.
My question is...are there any exceptions to this rule so that I may extend my stay and employment with my current employer beyond April 2006?
Thanks very much.
