H1 B Cap exempt?

Hi all,

Please help me with the info where my case is cap exempt for H1B.

My H1B petition was approved in 2008 and I have stayed in US during the following periods - Oct 2008 to Feb 2009 & Aug 2009 to Oct 2009, working for the same employer. In Nov, I have moved back to India and changed jobs. My original employer who filed for my H1B has cancelled my H1B when I left the organization in Nov 2009.

Now I would like to try for opportunities in US again. Can my new employer file for my H1B under Cam exempt case? What is the success rate of such cases? I am currently in India
