Human error
i have looked into different sources (official and non-official) about what goes on during this administrative processing, and I have found that there is no good reason for any case to be pending for more than 120 days.This 120 days limit is for those people whose case has either been returned to USCIS for re-evaluation of the petition or for people with an extremely common name that gets multiple hits. For people that fit neither of these criteria, there is just no reasonable excuse for their case to be extended beyond the average processing time, which is about 30 days. So if anybody's case has been extended for a long time, that almost certainly means some kind of error was involved. This error could be 1) the consulate just doesn't send the case to DOS (knowingly or unknowingly?) and thus the processing actually never even starts, 2)the consulate does not provide enough information about the case to the DOS and other relevant bodies, 3)there is an error in the communication between different bodies of the government and the cases essentially gets lost. The worst part is that there doesn't seem to be a system in place to check if such errors have been made. So, if somebody is unlucky then their case is just rotting around somewhere and noone even knows about it to do anything about it unless months or years have past. I suppose that's why the whole process is non-transparent, just so their mistakes aren't caught by the applicant??
Also, looking at the trend by which cases are solved, I feel like they don't really operate on strictly 'first come first serve basis.' I feel like they work on a certain number of cases from a certain day and then start working on cases from a latter day even though cases from previous day are still untouched. If you look to Chennai's trend of cases solved, you'll see that almost all the cases between June 11 and June 15 were issued within a week while none or very few cases between this period and May 20 are solved. How did that happen? Somebody just decided to skip directly to June 11-15 without first working on earlier cases?
Sorry for the long post. I am just very frustrated at this point and am trying to do the one thing that helps me while I wait, find out more about this process! Noone (especially innocent people that form the majority of administrative processing victims) deserves to be treated like this. Your future and career depends on someone else doing their job.
