  • Human error

    i have looked into different sources (official and non-official) about what goes on during this administrative processing, and I have found that there is no good reason for any case to be pending for more than 120 days.This 120 days limit is for those people whose case has either been returned to USCIS for re-evaluation of the petition or for people with an extremely common name that gets multiple hits. For people that fit neither of these criteria, there is just no reasonable excuse for their case to be extended beyond the average processing time, which is about 30 days. So if anybody's case has been extended for a long time, that almost certainly means some kind of error was involved. This error could be 1) the consulate just doesn't send the case to DOS (knowingly or unknowingly?) and thus the processing actually never even starts, 2)the consulate does not provide enough information about the case to the DOS and other relevant bodies, 3)there is an error in the communication between different bodies of the government and the cases essentially gets lost. The worst part is that there doesn't seem to be a system in place to check if such errors have been made. So, if somebody is unlucky then their case is just rotting around somewhere and noone even knows about it to do anything about it unless months or years have past. I suppose that's why the whole process is non-transparent, just so their mistakes aren't caught by the applicant??

    Also, looking at the trend by which cases are solved, I feel like they don't really operate on strictly 'first come first serve basis.' I feel like they work on a certain number of cases from a certain day and then start working on cases from a latter day even though cases from previous day are still untouched. If you look to Chennai's trend of cases solved, you'll see that almost all the cases between June 11 and June 15 were issued within a week while none or very few cases between this period and May 20 are solved. How did that happen? Somebody just decided to skip directly to June 11-15 without first working on earlier cases?

    Sorry for the long post. I am just very frustrated at this point and am trying to do the one thing that helps me while I wait, find out more about this process! Noone (especially innocent people that form the majority of administrative processing victims) deserves to be treated like this. Your future and career depends on someone else doing their job.

    Does anyone have the US consulate Contact # WITH OPTIONS so I can maybe call and speak with a live person? I do not find any options that fit my case and never end up talking with someone...just get kicked back to the "main menu" and dialing "0" doesnt take you to a representative either.

      I try not to think too much about it as it is not in my hands to change the situation. I take satisfaction in the fact that I have done nothing wrong and my case is 100% genuine. The worst that can happen is my employer may get impatient and ask me to take an indefinite personal leave OR for whatever reason my visa maybe denied. So what? It is not the end of anything. There is saying I heard from my elders "jiska rizzaq jahan likha hai wo wahin rahega" (one stays where his/her bread-earning is written).

      This of course does not mean I don't check the status everyday or I am not following this forum for updates... what I mean to say is be aware but don't be overly concerned.

        its even more disheartening and frustrating to know that you are stuck for so long due to a human error... I wish there was a way to contact consulate.. Escalating through trvel docs is the only way I guess.

        I am fed up waiting and looking for status on each day hundred times.. I am trying to take the Passports back from Consulate and fly to canada on work permit. My company is allowing me to work from canada for same client and project. Does anyone of you know if I can submit the passport in the Candian Consulate for stamping once the Admin Processing is complete.. In one of the forums I saw a person attended interview in Hyd and submitted the PPT in dubai after 15 months of Admin processing... Please suggest if its a good idea to go to canada...

        Also, for those of you in Hyderabad, lets plan to meet during frist week of Ramzaan Iftar... Will keep you posted with details.

          I have heard that they have been Visa Officers do reply on US Consulate's ******** page. And if you really feel that they have made mistake you can contact them on their Tweeter page. I am sure they will reply.

            By Grace of God, My attorney had success in getting LegalNet to force Mumbai post to work on my visa issue.

            Attorney contacted LegalNet twice.

            First time after 90 days and the result was "It is still pending with 221g"

            Second time (Waited for a month after 1 st try) - LegalNet did not reply. But US Consulate at Bombay replied and asked me to submit passports to get stamped.

              Thanks for your post. Can you pls send me the US consulate's ******** page....I am IT guy but never had time to even setup a ******** account :-) will do that now and see if I can get some help from there.

              Also luckily one representative (even though they are not allowed to talk anything about cases) did mention that in my case it "looks like a thorough name check" and I and my lawyer agree with that because I do have a v common name. both Mohamad and Khan along with a common first name too...but thats still no reason for them to have me wait for 10months....thats 300 days bro. I came for ramadhan eid last year!!! insane i tell you!!

              I have a meeting with my law firm today...will make sure they use all forces in their power (legal net, contact embassy etc etc) and get someone to push the case. God willing it will benefit me like it did in your case....good luck and have a safe flight back!!

                  and press option # 1 2 2 3 5 (one at a time). This is for Emergency appointment, but I see no other way to reach out to a live person.

                    Lowkey, your post reflects my sentiments exactly. It is so frustrating when you don't even know if your case has even been looked at. It might as well be sitting in the consulate where you interviewed, without having been sent to any agencies. All the while, we wait, having suspended our lives. If only there was some sort of time limit to this torture, we could move on with our lives. Its like hanging a carrot in front of the donkey, the donkey keeps hoping he will eventually get to eat the carrot.

                    I noticed the trend in Chennai consulate as well. Its as if one fine day they decide we will start from the most recent case, let those other cases just wait around. Mine is from May 15th and there are 20 case pending from that day. Cases from March, April etc still remain unresolved. I could go on and on...but none of this will lead us anywhere, except help us vent a little.

                    • I interviewed on May 14 and none of the cases from that day has been solved for that past 2 weeks (in Chennai), one more reason to think that they just decided to move on without working on them (would expect a slope rather than a sudden drop in processed cases if they were actually being looked at). What's worse for me is that I interviewed in kathmandu, and haven't found another soul going through it from there, so I don't even know the trend of solved cases from there.

                      My hope is alive but interest dies a little bit with every passing day. I do hope that yours and everybody else's cases will be solved soon!

                        I think there has to be more transparency in the process, so that we know what is going on and how much time it is required.

                        US is a developed country with their advanced technology blah blah... great. When I ask US consulate how much time it might take, they say there is no fixed timeline, we cannot estimate, I ask why not? Do you not have a standard process, do you not know how much time each process takes. I just dont get it?

                        We have not done anything wrong, we pay our taxes on time (more than average US citizen pays). We dont commit crimes like their citizens do in their country killing innocent kids for no reason, killing people in theators, shopping malls, killing immigrants at train station, gas stations, when was the last time you heard an immigrant killed someone, we are not involved in smugling or drugs most of their citizens are. No driving voilation tickets, you know we immigrants drive and how they drive. If you go to New York, you will see areas dominated by African Americans, even cops are scared to go in that area.

                        I read some one from this forum said, his family (wife and a small kid) is in US and he is struck in India, How terrible is that just think of it? I am not a desperate to stay in US, I am planning to move permanently in India, atleast I have some respect in my country. If US continues to do like this, it will soon loose all talent.

                        When I was a student, I had the same name, why did they not stop me at that time, ahh I see because if they stop me they cannot make 30,000 USD from my tuition fees. Why all of the sudden the name check into picture when I come on H1, hmmmm because I am taking jobs of their citizens, yeah right !!!

                        I dont understand this, why dont they do the check when they issue Petition, ahhh I see if they reject the application then, they will not be able to make $6000 from our employers. US now the biggest has credit in the world, it is the poorest country in the world, they need people who can pay regular taxes and support the government, but looks like government is no mood. They want to kick all good people who are paying taxes on time.

                        Employers in USA, could not find citizens who can work. They want immigrants who can work for them, when they earn more money they pay more taxes to government. Simple as that.

                        I ask a question, lets be honest, when was the last time we heard a terrorist being caught in US who is from India. They do so much analysis. They are increasing taxes for no reason in the name of security. Air ticket is $500, and taxes are $900, thats a joke seriously.

                        Security of citizens is equally important, I am not denying the fact, but there has to a limit, and their has to be some transparency. When Shah Rukh Khan a famous actor is stopped at airport just because he has a common muslim name, we could be stopped too and there is nothing wrong in doing the back ground check, but did he wait 8 months, NO!!!. Then why do we have to wait 8 months, because are labour and not a celebrity?

                        The fact is either they dont care about us or they dont want us back [period]

                          You are right, they don't care about us, nor do they want us; they just NEED us!! If they don't change their legal immigration system then soon enough the unnecesary abuse that immigrants have to face will make it a very unpopular destination. US taxpayers are sponsoring my phd training, but now their own investment is going down the drain due to this 'formality.' Security is very important but they are just shooting at their own foot because of paranoia. one can stay in the country for years without a hitch but as soon as they leave the country they are security risks? How would they feel if they were to go on a vacation and were told that they can't return home , can't go back to work, and can't be with their family for an indefinite time?

                          US touts about freedom and human rights, but only when it comes to americans. They are okay with using and abusing foreigners. Venting is not going to solve our problems, but at least it makes you feel better for a while! At least somebody knows what it feels like to be in this mess!

                            I am watching this forum from last 15 days. I have attended VISA interview on 21st march-2013 at Hyd Consulate along with dependent.VO took the passport's and told that you will get a mail please reply to that mail.I replied to that mail on 22nd march.After that there is no response from consulate.
                            I am from a big MNC. First time applied for H1B.

                              Hi Bro Which consulate ur interview is done? Mine is almost similar and My interview date is on 8th nov 2012 and still waiting and also I called DOS many times and recently passed 2 months they mentioning that my file is in chennai consulate and I may get reply in a week time but nothing is coming from chennai consulate.Last week when I called DOS a lady officer suggeted me to contact the chennai onsulate and I did very next day, Guess what the reply mail I get as same as always as follow

                              "Dear Sir,
                              Your case is still pending administrative processing, there is no time period within which administrative processing must be completed. Each application is processed on a case by case basis. We understand this delay can impact you and your family. However please be assured that we are continuously working to minimize processing times. Please continue to look at for the most up to date information regarding your case."
                              I'm really frustrated and now I'm thinking to get job in India or start some business in india.
                              Note: My name is very common muslim name 5 years back I attended interview in mumbai faced the same problem and got 5 years visa but this time takes longer....
