March'13, April '13 and May'13 are the worst hit months for the sample of my analysis. For these months many cases are still pending and the processing is ultra slow. All these pending cases are on 2nd or later conveyors having missed the 4-5 weeks window:

Since 10th of July: 20 Cases from May Cleared (Avg. 7 case per week)
Since 10th of June: 21 Case of April Cleared (Avg. 3.5 case per week)
Since 10th of May: 19 Cases of March Cleared (Avg 1.8 cases per week)

      Conveyor Analogy:

June'13 is doing pretty good so far. It has 336 cases pending and the processing lot is still at 10th of June. I'm of the view that it would come to the stable level of 75-80 pending cases by 1st week of July.

        Appreciate any response/views.
I would ask this question to your company's attorney and not in forum. Or speak to Customer Care on phone and explain the scenario, but this would be second option, first option is to contact your company's attorney.

        For my wife's visa

        Interview Date: 25th Feb
        Docs Submitted: 18th April
Case Updated Date: 12th March, 18th July

Actually i got response on 16th July from support for my email.
Do u think case updated date is due to the response for my email.
When your case date is updated it means your file is moving, and its not struck at any office and is getting required approvals. Recently a lady on H4 had sent an email and her case date was updated and with in a week she got her visa (She was fromm Chennai Consulate). So I would recommend you wait for few days and see what is their response.

I actually attended interview at the Hyderabad Consulate for H1B visa on 06/18/2013. The VO gave back all my documents, even passport and gave me a 221(g) white form. The only option checked is the one that says that I will receive an email from the consulate. I received the email 5 days after interview, and they asked me to submit my CV in .txt format and other supporting documents, if any, are available. I replied with all documents on 06/27/2013. The case was updated every 2 business with the same status - "Administrative Processing", until 07/11/2013. No updates since then. I do not understand why the VO gave my passport back.

I have to confess that I have been arrested/convicted in 2009 but the case was dismissed eventually in early 2010. The VO asked me about this arrest as I mentioned about it on my visa application. He asked for the court's dismissal documents. He went in and took copies of those documents. He said that I will get an email requesting my passport once the visa is approved.

          Thanks,
          Aj

          • someone somewhere

            Guys,
Some of you may know that I have been waiting for the past 7 months on admin processing. H1B and H4.
I have been tracking 2 other cases who interviewed on the same date as I did i.e. Dec 11, 2012. One of the cases changed status date yesterday and it shows issued today. Although this is not related to my case somehow I am glad that someone somewhere has got their visa.

Its normal to not take passport in interviews, I have read lot of posts where people said VO did not take passport later, they got email to submit passport and visa was issued. Since you mentioned you were arrested, they might do background check. Is this your first time applying H1, or H1 renewal and where were you arrested in US / India ?

              • Thanks, Tahersub4t!

This is my first H1B stamping. And I was arrested in the US. I sent fingerprints to FBI and did a background check before I traveled to India. The arrest record didn't show up. I also spoke to my immigration attorney about this and he assured me that this incident doesn't make me inadmissible to the US or deportable (according to INA). Any idea how long background checks take?

Unfortunately, I am also a victim of 221 g, I am waiting for almost 3 months now. There is no specific pattern for 221g cases, few got with in a month, few got with in 3 months, not to mention few are waiting for almost 6-8 months and more. I wish I had an answer to your question bro, we all are in the same boat.

You took a very big risk coming to India for visa stamping.

                  • Tahersub4t,

I know I took a risk, but I had to come anyway as it has been 7 years since I left to study in the US. Never visited India in between. Sometimes, "Kuch Paane Ke Liye, Kuch Khona Padtha Hain", time in this case.

One of the case out of them got issued yesterday so i guess we have to just wait for our lucky day.

                      • H1B 221(g) processing times, New Delhi

                        Hello everyone,

I was given the 221(g) white slip at the New Delhi embassy for my H1B stamping on the 11th of June, 2013, which was my visa interview date.
This is my second H1B stamping. I was in US from more than 5 years and 3 years with same employer.
221G is about submitting documents (petition, pay stub, client letters, contract and bank statements) even though i had everything available at the time of interview except client vendor contract papers.
I submitted all the required documents on 21st June (Friday), and my case status was last updated on 24th June (Monday).
Since then there is no update and all my e-mails/calls to the consulate have been pretty much in vain, since I get back the generic responses to "wait patiently".

I was wondering if anyone out their share same dates and got any update on their case.

                        Thanks

                        • For all the new victims on this forum, just an FYI - Today July24th is the completion of 11 months since my interview date on Aug24th 2012. Still no updates and as per the conversation I had with a DOS person a few mins back, my case is still being reviewed and is pending adminstrative processing :-)

Thanks Bro with this news. I had seen cases getting resolved in 6months and then after 1 year. its good to hear that some cases are issued in the 7-8month mark as well....

I am very close to losing hope and have to work on some plan B's and C's. Need to find a lawyer who can generate some sort of a power of attorney that I can give to someone in US giving him access to selling my stuff (car, furniture, electronics, house) etc....If I dont see any progress by or around Aug 24th of this year (my 1 year wait time) i might have to take a step.

have you tried applying for a fresh h1 since you are already under the cap exempt? and go for new visa stamping one more time ?
