Here's my case:
* I have an expired and unused H1B visa stamped in my passport (Valid from March 2006 to September 2008). I never used this.
* I have never been to the US on any work related visas (H1B or L1). I have been to US several times on short trips on B1 visa (my B1 Visa is still valid till 2016)
* I'm likely to get a job offer from a US based firm, and they need to apply for a H1b Petition for that
Questions:
1. Does the employer need to wait till April 2013 for applying for the petition under the new CAP for 2013 year? OR can they apply for CAP-exempt and reuse my earlier H1B petition?
2. If the latter, what all do I need to provide them for the CAP-exempt application? I only have the visa stamp on my passport, and it includes a P#
