    Hi,

    I joined a consultancy firm with a contract for 5 months. Now, due to personal reasons I am taking a break for 1-2 months after working for 2.5 months. Till now, I haven't been paid at all. I am asking him to pay me and he is giving me all sorts of reasons saying I have breached the contract, that I could have gotten another job, I need to continue work and only then he will run payroll etc.

    I want to file a case with DoL. I haven't been paid at all. Irrespective of the contract, I should be paid something. I don't get why the payroll was never run till now!

    Did anyone go through similar situation? How do you handle this

    You can complain for non-payment to DOL. They must pay you as per LCA for the work performed.

    But remember, you cannot arbitrarily stop working, that makes you out of status. You have to keep working to maintain status unless there is a genuine documented reason. Your employer can certainly sue you for breach of contract.
