    Hi!

    I have a current H-1B visa stamped till September 10, 2013. I wish to travel to India in March 2013 and be back by May 2013.

    My questions is

    1) Will I have problem at the POE since my current H-1B visa will be expiring in next 3 months?

    2) I plan on getting my H-1B renewed before leaving for India. But I do not wish to go for visa stamping with the new I-797. Will I be able to reenter the U.S. in May 2013 on my current H-1B visa (expiring in Sept 2013) and still have my new I-797 with me with a validity till 2016?

    3) Is it mandatory to get H-1B visa stamped once the new I-797 is issued?

    4) If I plan on getting H-1B stamped in India in March then will the embassy stamp H-1B visa for me in March with the New I-797 showing a start date in September 2013??

    I am in a similar situation as you were, did you had any issues with stamping or at the time of port of entry?
