  • Can I apply for H1B extension without amendment after I changed my end client?

    I have got my H1B in July 2012 and started on Oct 1st,2012. I got it for one year and is valid until Sep 2013.I changed my end client after I got my H1B. But I didn't apply for H1B amendment till now. Can I directly apply H1B extension without H1B amendment?

    After changing your end client, did your job duties change significantly? Was it for a different location in an area of employment not listed on the original LCA?

      @raghvi....Thanks for quick reply.

      "After changing your end client, did your job duties change significantly?"

      No. None of my job duites have been changed from what I have mentioned when I applied for H1B.

      "Was it for a different location in an area of employment not listed on the original LCA?"

      Yes. I am now working in the different location. I used to work in NYC when I got H1B now I am in SanDiego. So, Original LCA when I applied for H1B shows NYC now I have taken another LCA for the present location which shows Sandiego.

        If you got a new LCA then in this scenario I dont believe you need an amendment of the underlying H1B petition as such.

        This is my opinion not legal advice.

          Hi Syarabolu/Raghvi,

          I need advice/input on below question .

          I got my H1B in feb 2013 and came here in May 2013 for client A. After coming here i joined client B in June without new lca and h1b amendment as client A did not have opening that time.

          My company filled again for extension with Client B in August as my visa was also approved for a year. While filling for extension they got new lca in august and my extension got approved in November.

          I am going to India for stamping so just wanted to know in my client letter i need to show the work period from June or November

          Thanks-Senthil
