Second H1B application if first H1B still has 1 year left

One of my friends was here in USA for 5 years on H1B and went back to India 2 years back. He still has 1 year left out of his previous H1B. Is it possible to file a fresh H1B in fresh quota (April 2013) and will he get full 6 years again? Or his previous H1B will be extended for rest of its duration?

If a cap-subject petition is filed, it will give him fresh 6 years.
