  • Employer Change - H1 Transfer

    Hi,

    I initially came to US on L1B Visa but now I got the H1B approved with COS therefore I did not go for stamping since COS was approved till March 2015.

    Question: I am planning to change my job, can the other employer initiate H1B transfer? Will it be a problem since I do not have the H1B stamped yet?

    If the COS was approved you should currently be working only with the H1 employer. Though the new employer can initiate the transfer, it would be better if you have few months paystubs with current H1 employer in order to prove you are actively maintaining H1 status.

      Yes, I have been working with the previous employer and have 8-10 pay stubs for the same.

      Is it better to get the H1B visa stamped before the new employer initiates H1 transfer for me?
