Hello All,
I am currently working in US on H1B and my wife is working in an MNC in India. Now I am planning to bring my wife to US on H4. Her company in India has a policy of long term leave. They grant a long term leave for 1 or 2 years post which we can again join the company back.
Now can I have her opt for that long term leave in the company in India and bring her to US on H4 and file a H4 --> H1 conversion?
Does this H1 filing has any rule that she should not be enrolled in any companies pay rolls or on any leave policy in a different company?
