I assume this question had been asked lots of times already, but to satisfy myself I am raising it again, to be specific in my case.
Here are the sequence of events - I went to US on L1 in Dec 2006, Applied for H1-B in Apr 2007, got my H1-B petition approved in Oct 2007, Came back to India due to some personal reasons, Stamped H1-B in 2008 at Delhi.... but never went to US again. Visa was valid til 2010 and hence expired.
My question is -
1. Do I need to apply for H1-B again, if I want to come to US ?
2. Is my H1-B valid until the petition valid ? I have to check the petition validity though.
3. Can a new employer file for Fresh H1-B, based on my petition, if valid.
4. Am I subjected to CAP or not subjected to CAP ?
Basically, If I want to come to US, does the H1-B I got stamped in 2008, and never went to US, is helpful in any sense or not !
