H4 to H1 for my Spouse

My spouse got H4 in Dec-12 & trying for H1b this year (April - 2013)

Can my spouse go for COS H4 to H1 , someone told me that you have to be on H4 for 365 days before going for H1b.. Is this statement is true ?
