  • Two H1B Petitions from different employers

    Hi,

    I am currently working in the US with company A on an L1 visa. Company A has decided to file an H1B petition for me this year (on 29th March). Company A will be filing under premium processing, so the decision from USCIS will be out within 15 days. At the same time, I am also interviewing with company B which is also interested in employing me and are ready to file an H1B petition for me as soon as possible. My question is - if the USCIS receives two petitions, how will they look at it? Will they disregard the petition they receive later? Or, will they ask me which one I want to go with?

      They would not ask you who do you want to join !and they would not disregard the later application.
      You can choose who do you want to join, once both of the applications are approved.

        That means - two applications will be approved by them. A question in general - will they count it as two or one towards the 65,000 cap? Because if they count it as two, it technically is unfair to the other applicants, and due to the same reason, USCIS may not be too keen on approving two different applications from the same person.
