probability of mainainting status from denial H1

little complex but i would like to know someone could throw some advise,
I am in OPT status and am applying for H1 with a company but if it gets denied will it affect my stay in US legally? as for my spouse is in H1 so if denied can i apply as dependent H4 visa if not F1?

When does your OPT expire? Are you working in your field of study in order to maintain F1 status (OPT)?
