    F2 to H1

    I have an approved F2 and I am in India now. I was in US for 5 yrs and moved back on may 1st of 2012.

    Now my questions are
    1. If I apply for new H1 on first week of April and go to US on 1st of may, do I need to come back to India and attend for visa stamping?
    2. If I go to US before April 1st and apply for H1 will I get new H1 approved for full term(I am not out of US for full 1 year)?
