  • Hypothetical scenario - What after 6 years of H1B?

    Hello folks,

I am just hypothesizing a scenario, out of curiosity.

Say, an expert comes here in H1B, renews visa and completes the 6 years of his max. H1B duration. The expert doesn't do anything with regards to permanent residency but suddenly he realizes that he would like to stay here. Are there any legal ways to stay here and work?

One option, the spouse gets H1B, then he can live but not work.

    Thanks in advance.

If one needs to work after 6 Years one needs to be have the GC filed 365 days or more before 6th year completion. that is one has to find an employer who is willing to file and files their GC before 5th year completion on h1. Without timely filing of GC one cannot stay beyond 6th year completion.
Of course, if the expert is really rare then they might be eligible for GC under EB1 Category which enables them to get GC in quick time.

This is my opinion not legal advice.
