Hi,

My first H1B visa expires in October 2013. I left my sponsoring employer in July 2012, and moved out of the country. I would eventually like to return to the US, but do not want to be subject to the cap. How long am I considered 'cap-exempt' for? And if I do not find a willing employer before my visa expires, do I lose my visa altogether? Or is it still eligible to be renewed beyond Oct 2013?

How long am I considered 'cap-exempt' for?

For a total duration of 6 years spent in the US. The next time an employer files a petition, they can choose to either file a fresh H1B petition or a cap exempt petition.
