Cap Exemption of H1B

Guys,

I have query for cap exemption of H1B

Story:

I had stamping of H1B in 2008. In oct 2008 I went to USA and worked till Dec 2008. Due to deep recession I lost my job and returned to India. I have used my H1B I-797 only for 3 months.

After returning I have filed my w2 and change of address with IRS.

My H1B stamped visa got expire in 2011.

Queries

I got an opportunity where employer can file H1B for me. Can my previous H1B we used to get cap exemption? In case of CAP Exemption can be applied then what is the procedure I have to follow.

You can apply for fresh H1B visa BUT you will fall under Cap exemption.
So you just need to find an employer who can file fresh H1B visa for you.
You are cap exempt and no need to wait for Apr/Oct time frame.
