  • Changing from B1/B2 to H4

    I am currently visiting my husband (H1B holder) on a B1/B2 visa which I had obtained before marriage for official reasons. I am planning to return to my home country 2 months before the I-94 expires and then start the procedure for applying for a H4. Are there any potential complications involved? Is there any required mandatory waiting period before I can re-enter USA on the new H4 visa? Any information would be appreciated.

      Could you please advice on my situation:

      I was given a 221G blue slip on my H4 visa interview,on 4th April in Ottawa, Canada. VO told me that my application ig good to go but because my work is in Biotech field, there is some reviewing they need to do before approving visa. My last day on job is 30th April and by that time if H4 is not approved, is it possible for me to travel and stay in US on B2 with my husband (I have valid 10 years B2; should get min. of 6 month stay) and wait there until I get called by Ottawa (Canada) embassy to submit passport for H4 visa, OR this would be risky and not advised? Kindly provide your suggestions.

      What could be done in this situation. Thanks a lot.
