H-1 transfer and no compete

Hi,

My H-1B visa is valid till oct 2013 (first 3 years). I have a job offer but I have a no compete for 3 months.

What is the best way for me to stay in US and switch job?

If the new employer transfer my H-1B with joining date 3 months from now, do I have to go back to my home country or can I stay in US?
