My situation is completely different and may be new to some of you.
I m working on a H-1B visa to a company and I also have an EAD which I got through my spouse (filed in EB3) as a dependant. The problem is that the company to which I m working now started Green Card processing in EB2 for me and my Labor and I-140 got cleared. I m waiting for EB2 to become current, so that my I-485 can be filed.
But my company changed some policies and not doing any H-1B extensions for the people who have EAD/AD through their spouses. Now forcibly I have to use my EAD (which I got through my spouse) to continue working with that company.
My Question is: After my visa status changes from H-1B to EAD, if EB2 becomes current, then can I request my company to file I-485 for me even though I m EAD (being my H-1B expired)? Is it possible?
