  • Expired I-94 & traveling

    Hi All,
    I am in USA from July 2011. My H1b visa was extended till sept 2014.
    My I-94 got expired on Oct 2011.
    My questions are,
    1) Is us legal to stay in USA with expired I -94 & expired visa stamp on passport ?
    2) Can I travel to india with expired I-94 but with valid extension I-797?
    3) will there be a issue if my flight is via some other country since my visa Stan is expired in passport ?
    4) If this an issue then is there any way to get this done ?

    2) Can I travel to india with expired I-94 but with valid extension I-797? -- You should not have an expired I-94 as above.
    3) will there be a issue if my flight is via some other country since my visa Stan is expired in passport ? --Yes, some countries such as UK will require that you have a transit Visa since your US Visa has expired.
    4) If this an issue then is there any way to get this done ?-- See above.

        One last question,
        I have valid B1/B2 visa. Can I show b1/b2 at UK airport during changing my flight ?
        I am traveling from USA to india via UK.

            i94 expired but valid visa

            My wife has L2 visa till Dec 2018 (same as my L1). She applied for change of status from L2 to F1 in July 2017 but application still pending with USCIS.
            Her i94 is expired since Dec 2017 (56 days out of status). Attorney said that if her F1 arrives then there is no issue but if F1 is rejected that she will be out of status.
            Can she travel to Mexico and return to get fresh i94 stamped? Attorney said that there is a small risk that the officer may deny her entry to US.

            He advises going back to home country (India) to re-apply L2 and come to US. How much time L2 visa application takes? Can she start the process sitting in US and only go when her appointment is scheduled? This is because she is doing her Masters here and does not want to miss too many classes.

            Please advise.
