Question on H1 tenure

Hello,

I have a question on my current H1 tenure.

I stayed in the US on L1B from Sep 2009 to Oct 2011 (my L1 was expired in July 2011 itself, but I received the extension denial notice only in Oct after which I immediately returned back to India)

My employer applied for H1B and I received the petition valid from Oct 2012 thru Sep 2015. I have returned to the US on H1 in Feb 2013.

Will my H1B Visa be valid for fresh 6 years (with extension) starting from Oct 2012?
OR
Will my L1 stay be counted and the same being reduced from the H1 period?

Since you were outof US for more than a year, you should be good for another 6 years I believe.

Since you left in Oct 2011 only if the H1 petition was applied in Oct 2012 or later you would be eligible for fresh 6 Years H1. I guess you applied for H1 before Oct 2012 so you may not be eligible for fresh 6 Years H1. Do check with your lawyer.
