I have an I-140 approved 3 years back and waiting to apply for I-485. I am on H1B and on my 8th year in US. I got another offer and would like to switch the company. So I would like to understand how the switch will impact my current H1B and GC processing. I was told the current employer can withdraw I-140 and if he does that will in turn invalidate the H1B and GC priority date. Is that true? Please advise the options I have.
If the current I-140 is not withdrawn by the current employer, then my understanding is my new H1B submitted by my new employer should go through fine and i can keep the same priority date for my GC, but the new employer should submit PERM and I-140 again for me. Please correct me if that is not the case.
