Dear Team,
I am currently working on L2-EAD visa. Earlier I was in US on H1B visa for a total duration of 1.5 years. My H1B visa was revoked when I resigned from my old employer in June 2011. I am searching for a new job and am looking for H1B out of cap sponsorship.
1) Can my new employer process my H1B under out of cap category ?
2) Do I have to be on their payroll before they start processing my H1B or
3) Is it possible for my new employer to initiate H1B out of cap before I join ?
I want to make sure that my new employer applies for my H1B out of cap before I take up the offer.
