  • H1B Expired on 31-Jul-2012 - Never traveled to US

    Hi Experts,

    My case in a nutshell:
    1. I was working with Company A and got my H1 B visa in 2009 for Client X. Applied for H1 transfer for client Y from company A only in 2011 Dec but it went into RFC mode and then my company A filed an appeal and by the time h1 transfer was approved , my H1 B got expired ( 31-Jul-2012).

Now, I left my job with company A and joined a new company B. So basically I had an H1 B approved petition in 2009 which got expired on 31-Jul-2013(In between it went for H1 transfer to new client and RFC)

Current status on USCIS website ( My case status ) -
On August 13, 2012, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER

I just want to understand now that can I still reuse the petition number and get it renewed or a new petition filed based on old one from my new employer Company B .

If I ask my current employer to file a renew or new H1B petition , till what time it can be filed without falling in cap limit ( I guess 2009 + 6 =2015 or since H1 B transfer was approved on 13 Aug 2012 , it will be 2012+6=2018). The receipt number issued in 2009 is different from the one which was issued during H1 transfer (2012).

    Thanks a lot in advance.

    Chammi
