H1b Transfer Information

Hi ,

I am working with Company -A in India and my H1B petition approved and valid till next year. Now I got an offer from another Company B in India.
Is it possible to transfer from CompanyA to CompanyB without having any H1B papers like i797 & i94.

[[If I left the companyA with valid "Receipt number" then will it be possible transfer to another CompanyB to file H1B Visa]]

Hi ,

I am working with Company -A in India and my H1B Visa is still valid. Now I got an offer from Another Company B in India. I need to Transfer my H1B Visa from Company A to Company B.
I left the company A with out taking any H1B papers and I have approved “Receipt Number”.
Please help me with answer the below queries.
Note:
1. Will CompanyA Cancel My H1B Visa immediately after I Quit from the Company and will take all the Visa documents? -- They may withdraw the petition, but it will make no difference to you.
2. I did not get in to USA with H1B after get it stamped. Is the Visa transfer is possible when I am not visited once while I am in India? Both company A and B are in India. --B can file a cap-exempt petition for you. (B's US subsidiary will). B will need at least the receipt number for A's petition. Some companies will insist on seeing the approval notice, so you may need to convince them that it is not necessary. The Visa obtained using that petition is sufficient proof that the petition was indeed approved.

2. When we can initiate the Visa Transfer Process? After Joining Company B or Now itself we can initiate the Process? -- B can file at any time.

3. How long it will take to get the approval for H1B visa transfer? -- Same as any other petition, 2 to 3 months in regular processing 15 days in Premium.

4. If company A will cancel my Visa, How long it will take to cancel, I mean up to how long my visa will be valid and I can initiate my Transfer process. -- They will only withdraw their petition. The Visa in your passport will remain valid. You can use the same Visa with the new company's petition to travel to US.

5. If the Company B Just initiates the process and immediately company A applied for cancel my H1B visa before I get the Transfer approval, Is this will impact to the Visa transfer process and is there any chance to reject my Visa transfer? --See above. A's actions make no difference to you.

6. Please suggest me what I should do in such case? -- See above.
