  • Unutilised H1B petition

    Hi All,

I have a appoved H1B petition for a period of Nov2012 - Nov2013. The petition is expiring this november 12th. Unfortunately my company couldnt find an opportunity within this november. I have not yet got the passport stamped.
Is there any possiblity that I could file an extension from India.

Kindly let me know if you need more details.

    Regards,
    Pratheep

For that to happen, you would first need to have an employer need you to go to US for work. That in turn means the employer would need to have work for you. So if your current employer doesnt have work for you in US then they will not be able to extend the petition. If you want you can find another employer and ask them to file a petition for you and if petition is approved you can take the new petition and get the visa stamped.

This is my opinion not legal advice.
