  • Question about Visa Stamping .

    Hi All ,

    Could you please help with the following ..

    I am on H1B from Employer A , I changed to Employer B after 6 months .
    My Employer B I797 is valid until . 05/10/2014

    My H1-B Stamp from Employer A on passport is until 2 Jan 2014
    My I 94 is valid until 12 Jan 2014 .
    My passport has expired ,So original Visa is in old passport . I have a new passport which i will be carrying with the old one .

    I am traveling to India in NOV and will be back by Dec-1st .
    Do i need to go in for re-stamping . I have heard mixed answers for this from sources .
    But would like to get expert opinion .

    Does the approval notice for B's petition have an I-94 at the bottom? If so that is your I-94 and it expires with the petition (5/10/2014).

    Technically, you don't need a new Visa, you can use the same Visa with the new petition to travel to US. However, recent POE reports indicate that CBP is only issuing I-94's according to Visa expiry and not petition expiry. If that happens, you will need to extend your status before it expires.

      Thank you for your response .
      The H1-B petition does have an I-94 at the bottom .
      It expires 05/10/2014 . I was just concerned ..since i have a new passport .
      So i will not need to get stamping for my this travel ?
