Dear Experts,
Please answer my below query and suggest:
I have a petition for H1B approved in year 2010 ( Oct 2010 to Sep 2013), but my Visa was refused and sent back to USCIS for review. I never came back to USA for 3.6 years. The petition was never revoked or canceled by my employer.
I am now in United Status on a valid H4 Visa which is valid till Sep 2013.
My question is : Is it possible for my employer to file an application/ petition to USCIS seeking change of Status from H4 to H1(on my previous H1 petition) with an extension since I have no utilized all 6 years of my H1B limit
