Hello I have a general question regarding my wife's travel back to US.
My current H1 visa and also my wife's H4 visa are going to expire in October 14th 2013. So I have applied for H1 extension through my employer. But my wife is in India right now so I couldn't apply for her H4 extension. My wife will be back in US in September 18th 2013. She is having a H4 visa stamping in her passport which is valid till October 14th 2013. I have applied for my H1 extension in premium processing.
My questions are..
1. I wanted to know whether my wife will have to go to US consulate in India for H4 visa stamping after I get my new H1 approval? I am guessing that I will get my new H1 approval before she returns back to US in September 18th 2013.
2. She is having a valid H4 visa stamp till October 14th 2013, So can she travel back to US with her current stamping a show my new H1 approval notice at Customs and Border Petrol (CBP) at airport and get her I94 according to my new H1 approval notice? When she is back can I apply for her H4 extension again? Please let me know.
