    Working for Company A with L1 expring 12Oct2013. H1B COS approved from Employer B. Due to EVC model rejections in india while stamping, want to stick with Company A.
    Scenario 1. Can I get my approved H1B transferred to Company A after Oct 1st and start working with company A? if yes, when should we initiate this and will be in out of status? Also, Will my Employer B, revoke my H1? What are the list of original documents I need from Employer B for H1b transfer?

    Scenario 2. If I go back to india, can I get my approved H1B transferred to Company A and go for visa stamping? Will my Employer B, revoke my h1?

    Sticking to current L1 employer after H1B approval

    You can use your approved petition and file for H1B transfer thru employer A with premium processing. You have to do this before 1st Oct otherwise by default you have to work with employer B from Oct 1st. If you have approved H1B petition that is sufficient to transfer to employer A.

      You can have Company A transfer you H-1B to them. It can be before or after October 1 as you have already been counted towards the cap. Employer B can revoke your H-1B. the H-1B should be transferred before revocation.

      You can’t get H-1B stamping until an H-1B for company A has been approved.
