I have received my H1B approval notice. I am going to India for official training in mid September and plan to return to US after 1st Oct after getting my H1B stamped at the Mumbai Consulate. I had 2 concerns:
1. While filing for my H1-B petition the law firm had misspelled my last name in the I-129 form ( typo -they put an H instead of L). My H1B petition has been approved and the approval notice (I-797) form has my name spelled correctly. My company's immigration department told me they cannot amend my last name as the petition has already been approved with the correct name. Do you think I will face problems at the Visa Stamping?
2. Just in case my H1B does not get stamped, can I return to US on my F1- OPT visa? My company had applied for a change of status from F1 to H1 for me.
