URGENT Query related to I-129 amendment before going for stamping for new H1B visa

    Hello All,

    I have a question related to missing information from I-129 form.

    My case details -

    I got H1B approved for this current year 2013. I am an Indian national currently residing in Hong Kong on work permit. I have to go Hong Kong consulate for H1B stamping. Earlier from Oct 2004 to Oct 2010 I have worked in US on H1B, was never out-of-status and have all W2 and tax statements.

    I have just got packet from my employer for NEW H1B stamping for current year and I found out that there are few details missing from the I-129 form - following are the field with missing or incorrect details -
    (a) SSN (if any) - I have SSN but its mention N/A. Please note currently I am not in US.
    (b) List of all prior periods of stay for beneficiary on H or L visa - This section is blank.

    Actually when I got checklist of documents from my employer it was mentioned to provide Copies of all Current and/or Previous Nonimmigrant Visa Approvals [Form I-797 & I-129], if currently in the US on H1B, H-4, L-1, J-1, TN, or F-1 status. So I was not in USA that time, I was in India and I didn't provided these informations.

    Anyhow now what is done is done, for now (H1B stamping) I asked my employer what to do for this misisng info from I-129 form. He said no need to worry about this information not being entered in I-129 as it is a new H1b and not extension or anything, but you may carry your previous I-797, W2 statements with you and if asked you may show it to visa officer.

    My concern is that with no SSN and no mention of my previous H1B details, will my stamping get jeopardize. My employer mentions since these information are not important when filing new H1B I don't need to worry about it. Please advise what should I do to get successful H1B stamping keeping in mind that in future I pose no issue at port of entry and my GC process does not get jeopardized in future due to no information of previous H1B in my current I-129.

    Also is applying for I-129 amendment advisable in this situation or I should directly go H1B stamping?

      I think you should get all the info amended and then got for stamping.
      Its better to be late for stamping than result otherwise.

        what kinda questions they ask in F4 I130 imm visa call ? any idea ?
