HELP - visa status needed to apply H1B

Hi,
This is sanjeev completed MSc in UK. I applied for H1B and its been approved and now I need to attend interview at US embassy in UK. Currently my student visa is expired. Only chance left with me is to apply for Visit visa in UK. Can I know is it possible to attend interview at US embassy on Visitor visa. OR is it better to apply to go to India and then apply from there. If so can some one suggest the probabilities comparing to applying in UK. Thanks in advance. Please help me out.

Hi Sanjeev,
You should first verify from an attorney in the UK as to whether you can actually change from a student to a visitor in the UK. If you are out of status, the sooner you leave the country , the better. In UK any application made for Further Leave to Remain or Extension will be considered only if on the date of making the application, you have maintained status. Therefore, it is best you apply for H1B from India.
