  • Cruise on a H1-B

    Hello,

I am on an H1-B visa status right now. I have the I-797 approval form which shows that my status is valid until October, 2015.

I do not have the H1B visa stamped on my passport.

I am considering going on a cruise to Central America - Mexico, Belize and Honduras.

I am wondering if re-entry would be possible without a passport showing the H1-B visa. Could I show my I797 instead at the border check, provided there is one? If I797 is not good enough, are there any additional documents I could take with me that would make re-entry possible?

    Thanks for your help.

    No. Valid stamp is necessary.
In your current situation without a valid US stamp, you cannot even enter Mexico.
This is my opinion. Not a legal advice

You will need a valid US Visa to return to US.

You may also need Visas to all the countries that you are visiting.
This is my opinion and not legal advice.
